Purchase Chocolate & Fountains

This contract is the sole property of Dessert Carnival and can not be reproduced in any way.

We deliver fountain to the event.
We setup the fountain and get the chocolate flowing.  
Take the fountain down at the end of your event and take it away.
We do not clean anything that is not in the chocolate fountain.

This agreement is made and entered into by the Client _________________ and Dessert Carnival for services referenced below. No other agreements whether expressed or implied are valid unless in writing and signed by both parties.

  • No fountains setup outside please.

  • Rental of the 19" fountain is for a period of up to 3 hours and includes 6 pounds of Belgian chocolate and wooden fork skewers enough for 50 guests per fountain being rented.

  • Our Commitment: Our experienced delivery people will set-up the fountain and tear down fountain after event.

  • Deposit: A non-refundable $50.00 down payment is required to hold your date.

  • Payment: Check payment can be made and sent to our mailing address below. Full payment must be received 2 weeks prior event. Payment can be made through Paypal at our web site and will incur a service charge of 3.42% .

  • Cancellation: Cannot be canceled, except in writing, by either the Client or Dessert Carnival. When the Client initiates the cancellation two weeks less prior to the event, fountain rental total amount will be forfeited.

  • Client provides the following: 1 sturdy, level table. 1 skirting, 1 table linen and 6-inch dessert plates per fountain rented. Tables not allowed for use include any table with a singe center leg.

  • Travel Fee: Incurred for travel outside 78758 area beyond 20 miles at the rate of .50 per mile round trip.

  • Utilities: Sufficient power for the operation of the Chocolate Fountain, which requires at least one 120-volt circuit that will supply at least 15 amps within 15 feet of the setup area.

  • Mutual Indemnification: Each party hereby agrees to indemnify and hold harmless the other against any losses, including costs and attorneys' fees, as a result of any claim, action, or proceeding arising out of, connected with, or resulting from the use of the Chocolate Fountain at the event. The maximum amount of any costs or damages you may recover from us as a result of our conduct pursuant to the foregoing is limited to any payments you have made to us under this Agreement, plus simple interest at the rate of ten percent (10%) per annum thereon.

  • Additional Terms: We bear no responsibility in the event of a failure of our equipment, products or services due to an event outside of our control, such as a power outage, act of God or other force majeure. In the event we otherwise fail to provide the products or services as contracted for, your sole remedy will be the refund of all monies you paid to us plus simple interest thereon at the rate of ten percent (10%) per annum. We make no warranties, express or implied, regarding our equipment and products except those required by applicable law. The liability of Dessert Carnival to perform the said services is subject to proven detention by sickness, accidents, or any other actions not under its control.
  • Disputes: And controversies arising out of or connected with this Rental Agreement are to be governed by Texas law and the venue of any such action or proceeding relating thereto shall be the State of Texas, County of Travis, and City of Austin.

  • Notices: Any notice required or permitted under this Agreement shall be given by either of the following methods; fax, e-mail, overnight express delivery or by U.S. Mail. Any such notice shall be deemed to be given on the date it is given if by facsimile or e-mail, or on the date the notice is actually delivered if given by overnight or express delivery, or on the third day after which the notice is deposited in the U.S. mail if given by U.S. mail.

By signing this contract the Client indicates that they have read, understand and agree to all of the terms listed.
